Terms of Service

Terms and conditions for using the Arcana tarot platform.

§ 1 GENERAL PROVISIONS

  1. The website www.arcanaoftarot.com operates in accordance with the terms set out in these Terms of Service.
  2. These Terms of Service define the conditions for entering into and terminating Agreements, the complaint procedure, as well as the types and scope of services provided electronically through www.arcanaoftarot.com, the rules for the provision of such services, and the conditions for entering into and terminating agreements for the provision of electronic services.
  3. Each User, upon undertaking any actions aimed at using the Electronic Services of www.arcanaoftarot.com, is obliged to comply with the provisions of these Terms of Service.
  4. The website www.arcanaoftarot.com provides access to artificial intelligence-based tools for generating personalized tarot card readings, interpreting card symbolism, conducting conversations with the Oracle, maintaining a spiritual journal, analyzing patterns and trends in readings, and creating Soul Card profiles. The Platform offers Digital Services on a freemium model — basic access to the Platform is free (Seeker plan), while full functionality is available through purchasing a renewable Premium Subscription or through a One-Time Payment for Credit Packs (transactions are processed by the payment operator Stripe). All content, readings, interpretations, analyses, and visualizations generated and available within the Platform’s Services are intended solely for the Client’s personal use, unless these Terms of Service provide otherwise.
  5. The website www.arcanaoftarot.com delivers generated tarot readings, card interpretations, pattern analyses, monthly reviews, and Soul Card profiles solely for entertainment and personal reflection purposes. The tools available on the Platform do not constitute and do not replace professional medical, psychological, financial, or legal advice. The User acknowledges that AI-generated tarot card interpretations are created algorithmically based on traditional tarot symbolism and should not be treated as predictions, prophecies, or statements of fact. The Platform Administrator shall not be liable for any decisions made or actions taken based on content generated by the Platform.
  6. The Platform may only be used by persons who are at least 16 years of age. By registering on the Platform, the User confirms that they meet this age requirement. For persons under 16 years of age residing in the European Union, parental or legal guardian consent is required in accordance with Article 8 of the GDPR.
  7. For matters not regulated in these Terms of Service, the following shall apply:
    • the Act on the Provision of Electronic Services of 18 July 2002,
    • the Consumer Rights Act of 30 May 2014,
    • the Act on Out-of-Court Resolution of Consumer Disputes of 23 September 2016,
    • the Civil Code Act of 23 April 1964, and other applicable provisions of Polish law.

§ 2 DEFINITIONS

  • TERMS OF SERVICE — these Terms of Service for the Platform.
  • PLATFORM — the Service Provider’s online platform operating at www.arcanaoftarot.com.
  • ELECTRONIC SERVICE — a service provided electronically by the Service Provider to the User through the Platform.
  • ACCOUNT — an Electronic Service made available to the User upon registration on the Platform, allowing access to Platform functionalities, including reading history, journal, preferences, and Digital Services available under the User’s current plan.
  • REGISTRATION FORM — a form available on the Platform enabling the creation of an Account. Registration is possible via a Google account (OAuth), Apple account (OAuth), or email address and password.
  • ORDER FORM — a form available at www.arcanaoftarot.com enabling the placement of an Order for a Premium Subscription or Credit Pack.
  • ORDER — a declaration of intent by the Client constituting an offer to enter into an Agreement for the Delivery of a Digital Service with the Seller.
  • SELLER, SERVICE PROVIDER — Damian Idczak conducting business under the name Damian Idczak, registered office: ul. Niedas Leśny 26a, 95-080 Tuszyn, NIP: 7282893112, REGON: 540577030, email: contact@arcanaoftarot.com, phone: 888753735.
  • USER — a natural person, legal entity, or organizational unit without legal personality to which the law grants legal capacity, using an Electronic Service.
  • CLIENT — a User who intends to enter into or has entered into an Agreement for the Delivery of a Digital Service with the Seller.
  • CONSUMER — a natural person who enters into a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
  • ENTREPRENEUR — a natural person, legal entity, or organizational unit conducting business or professional activity in their own name.
  • DIGITAL SERVICE — a service enabling the Client to produce, process, store, or access data in digital form. The Digital Service provided on the Platform is access to personalized AI-generated tarot readings, Oracle conversations, spiritual journal, Soul Card, pattern analyses, monthly reviews, and related functionalities, obtained through the Account.
  • AGREEMENT FOR THE DELIVERY OF A DIGITAL SERVICE — an agreement entered into between the Client and the Seller through the Platform, the subject of which is a Digital Service.
  • SEEKER PLAN — a free access plan to the Platform, enabling the use of a limited range of functionalities, including two readings per week from four basic card spreads.
  • PREMIUM SUBSCRIPTION — a paid electronic service enabling unlimited access to all Digital Services for a specific Subscription Period. Available in monthly and annual variants.
  • SUBSCRIPTION PERIOD — the period during which the Digital Service under the Premium Subscription is delivered. Monthly and annual periods.
  • CREDIT PACK — a one-time purchase of a specified number of reading credits. Credits do not expire.
  • CREDIT — a unit entitling the holder to perform one tarot reading from any card spread.
  • TRIAL PERIOD — a free, seven-day period from Account registration, during which the Client has access to full Premium functionality.
  • READING — a service consisting of an AI-generated interpretation of drawn tarot cards within a selected card spread.
  • ORACLE — a Platform functionality enabling conversation (chat) with AI in the context of a completed Reading.
  • SOUL CARD — a numerological profile generated based on date of birth, including personality card, soul card, shadow card, AI-generated personality portrait, and character traits.
  • ORACLE NOTES — internal notes generated by AI after each Reading, containing emotional state assessment, themes, and contextual observations.
  • PRICE — a value expressed in monetary units that the Client is obliged to pay the Seller.
  • DIGITAL ENVIRONMENT — computer hardware, software, and network connections used by the Client.
  • COMPATIBILITY — interoperability of the Digital Service with typical hardware or software without modification.
  • FUNCTIONALITY — the ability of the Digital Service to perform its functions with regard to its intended purpose.
  • INTEGRATION — connecting the Digital Service with elements of the Client’s Digital Environment.
  • INTEROPERABILITY — the ability of the Digital Service to interoperate with hardware or software other than those typically used.

§ 3 INFORMATION ON DIGITAL SERVICES AND ORDERING

  1. The website www.arcanaoftarot.com sells Digital Services via the Internet.
  2. The Digital Services offered on the Platform are Functional, Compatible, and Interoperable with hardware meeting the technical requirements specified on the Platform’s website and/or in these Terms of Service.
  3. The information on the Platform’s web pages does not constitute an offer within the meaning of the law. By placing an Order, the Client submits an offer to purchase a specific Digital Service under the conditions set out in its description.
  4. The Price of a Digital Service displayed on the Platform’s website is quoted in United States Dollars (USD) and includes all components.
  5. The Price displayed is binding at the time the Client places the Order. This Price shall not change regardless of any Price changes on the Platform after the Order.
  6. The Seller clearly informs Clients about unit Prices and promotions. Alongside reduction information, the Seller displays the lowest Price in effect during the 30 days preceding the reduction.
  7. Orders may be placed through the website using the Order Form — 24 hours a day throughout the year.
  8. The Platform enables Account registration without purchasing a Premium Subscription or Credit Pack. Upon creating an Account, the Client gains access to the Seeker Plan (free) and a seven-day Trial Period with full Premium functionality.
  9. A prerequisite for placing an Order is having an active Account, reviewing these Terms of Service, and accepting their provisions.
  10. The Platform offers the following plans and packages:

    Seeker Plan (free):

    • 2 readings per week (reset every Sunday at midnight UTC),
    • 4 basic card spreads: Daily Card, Past/Present/Future, Weekly Guidance, Birthday Oracle,
    • 2 follow-up messages in Oracle Chat per reading,
    • access to reading history and journal,
    • 700 interpretation tokens per reading.

    Premium Subscription:

    • Monthly variant: $7.99/month,
    • Annual variant: $59.99/year,
    • unlimited number of readings,
    • all 13 card spreads (including Celtic Cross, Chakra, Tree of Life, Week/Month/Year Ahead, Love & Relationship, Career Path, Yes/No, and more),
    • unlimited Oracle Chat,
    • full Soul Card profile (portrait, traits, shadow card, sharing),
    • Life Chapters,
    • Pattern Insights,
    • Monthly Soul Review,
    • 1,000 interpretation tokens per reading.

    Credit Packs (one-time payment):

    • 3 readings for $4.99 ($1.66 per reading),
    • 8 readings for $9.99 ($1.25 per reading),
    • 20 readings for $19.99 ($1.00 per reading).

    Credits do not expire. Credit Pack readings unlock all 13 card spreads with 1,000 interpretation tokens and 2 follow-up messages in Oracle Chat.

  11. The Digital Services are intended solely for the Client’s own use and may not be used for advisory, therapeutic, or informational purposes for other persons.
  12. The technical requirements are provided by the Seller in the description on the Platform’s website.
  13. If a Digital Service is subject to updates, the Seller informs the Client about updates and the consequences of not installing them: for continuous delivery — throughout the Agreement; for one-time delivery — for a reasonably expected period.
  14. The Client is obliged to install updates within a reasonable time. Failure to do so releases the Seller from liability for non-conformity.

§ 4 CONCLUSION OF THE AGREEMENT FOR THE DELIVERY OF A DIGITAL SERVICE

  1. Registration of an Account is equivalent to entering into a free Agreement for Account management and obtaining access to the Seeker Plan and the Trial Period.
  2. To enter into a paid Agreement (Premium Subscription or Credit Pack), the Client must first place an Order in accordance with § 3, points 7 and 9.
  3. After the Order is placed, the Seller promptly confirms its receipt.
  4. Confirmation of acceptance binds the Client to their Order. Confirmation is sent by email.
  5. The confirmation contains: confirmation of all essential elements, a withdrawal form, information about loss of right to withdraw, and these Terms of Service.
  6. Upon receipt of the confirmation email, the Agreement is concluded between the Client and the Seller.
  7. Each Agreement shall be confirmed by proof of purchase sent by email.

§ 5 PAYMENT METHODS

  1. The Seller provides the following payment methods: electronic payment system (Stripe), and BLIK payment (available exclusively for Credit Packs).
  2. In the case of electronic payment, the Client makes payment before the Order is fulfilled. Payment may be made by credit card, debit card, or instant bank transfer.
  3. The Client is obliged to pay the Price before the Digital Service begins, unless the Agreement provides otherwise.
  4. The Digital Service shall be delivered only after payment has been made.
  5. A Premium Subscription activates a Subscription that renews automatically at the end of each Subscription Period. If not cancelled, the established amount is charged at the beginning of each subsequent period.
  6. A Credit Pack purchase constitutes a one-time payment. Credits are added immediately upon positive payment authorization.
  7. BLIK payment for a Credit Pack does not activate a renewable Subscription.
  8. The Premium Subscription may be cancelled through the billing portal in Account settings. Premium access is blocked after the last paid period. Unused Credits are not affected.

§ 6 DIGITAL SERVICES

General Rules

  1. The Digital Service is delivered after the expiry of the withdrawal period, unless the Client has given express consent to delivery before expiry.
  2. Delivery takes place through the Client’s Account within 24 hours of positive transaction authorization.
  3. Detailed descriptions are available on the Platform’s website.
  4. The Seller delivers the Digital Service in the latest available version.
  5. The Seller shall regularly perform technical maintenance during night hours. Users will be notified 24 hours in advance unless it results from a sudden failure.

Trial Period

  1. Each newly registered Client receives a free, seven-day Trial Period with full Premium functionality.
  2. The Trial Period begins automatically at registration and ends after 7 days. No fees are charged.
  3. After the Trial Period, the Account transfers to the Seeker Plan. Reading history is retained.
  4. After the Trial Period, a Client without Premium gets one free Premium-quality reading per calendar month.

Platform Functionalities

  1. The following functionalities are available:
    • Tarot Readings — generating personalized interpretations within a selected card spread, with the option to pose a question or set an intention,
    • Oracle Chat — conversation with AI in the context of a completed Reading,
    • Daily Card — daily random tarot card with personalized interpretation and Moon phase,
    • Journal — personal journal with reading links and mood tags,
    • Soul Card — numerological profile based on date of birth,
    • Life Chapters — Premium feature analyzing patterns to identify major life periods,
    • Pattern Insights — analysis of recurring cards, themes, and trends,
    • Monthly Soul Review — Premium personalized analysis of monthly patterns,
    • Oracle Notes — internal AI-generated notes used to improve future readings.

Content Sharing

  1. The Client may share Reading results via unique public links. Shared content is visible to anyone with the link.
  2. Premium Clients may share their Soul Card profile via a unique public link. Sharing can be toggled in Account settings.
  3. The Client is responsible for content shared publicly. The Service Provider is not liable for consequences of sharing.

Artificial Intelligence and Its Use Within the Digital Service

  1. AI Outputs are created automatically based on data provided by the Client (questions, intentions, selected spreads, journal entries, onboarding preferences).
  2. The Service Provider transfers to the Client all applicable rights for AI Outputs, including recording, reproduction, modification, publication, distribution, combining with other works, and marketing.
  3. The transfer of rights takes effect at the moment the AI Output is generated.
  4. For AI Outputs not constituting works under copyright law, the Service Provider grants an irrevocable, non-exclusive right for both commercial and non-commercial use.
  5. The Client acknowledges that AI Outputs may contain elements similar to publicly available content. No guarantee of originality.
  6. The Service Provider does not use Client data for model training without separate, express consent.
  7. The Client may consent to use of AI Outputs for promotion and public sharing.
  8. Model training uses only legally usable data without infringing third-party rights.
  9. The Client acknowledges content is AI-generated and must disclose when required by law.
  10. The Client agrees not to use the Service to create deepfakes, misleading content, content presenting readings as professional advice, or content infringing copyright or data protection regulations.
  11. The Service Provider reserves the right to block or remove violating content and to forward information to appropriate authorities.
  12. The Client may not reverse engineer, disassemble, or decompile the Platform’s system.

§ 7 COMPLAINTS

  1. The basis and scope of the Seller’s liability towards Consumers for non-conformity of the Digital Service with the agreement are defined in the Consumer Rights Act of 30 May 2014.
  2. The basis and scope of liability towards Entrepreneurs are defined in the Civil Code Act of 23 April 1964.
  3. The Seller is liable for non-conformity: for continuous delivery — for the entire Agreement duration; for one-time delivery — for non-conformity existing at delivery and discovered within 2 years.
  4. The Client is obliged to cooperate with the Seller to determine whether non-conformity results from the Client’s Digital Environment.
  5. Notifications of non-conformity may be made via email at: contact@arcanaoftarot.com.
  6. The email should include as much information as possible regarding the complaint.
  7. The Seller shall respond no later than within 14 days of the complaint being filed.
  8. Failure to process a Consumer complaint within 14 days shall be deemed as acceptance.
  9. The Client may first request that the Digital Service be brought into conformity. Price reduction and withdrawal are available only as specified by law.
  10. For justified complaints, the Seller shall: bring the Digital Service into conformity at its own cost, reduce the Price, or refund the Price within 14 days.
  11. The response to the complaint shall be provided on a durable medium (e.g., email).
  12. The Seller is not entitled to demand payment for the time during which the Digital Service was non-conforming.
  13. The Seller is obliged to refund the Price only for the non-conforming part.

§ 8 RIGHT OF WITHDRAWAL FROM THE AGREEMENT

  1. Subject to point 4, a Consumer who has entered into a distance agreement may withdraw within 14 days without stating reasons.
  2. In the event of withdrawal, the Agreement shall be deemed not to have been concluded.
  3. The fourteen-day period is counted from the date of conclusion of the agreement.
  4. The right to withdraw does not apply for: services fully performed with express consent, and digital content delivery with express and prior consent.
  5. The right to withdraw is available to both parties in the event of the other party’s failure to fulfill obligations.
  6. After withdrawal, the Seller may not use content provided by the Client, with specified exceptions.
  7. The Seller shall, at the Client’s request, make available content other than personal data in a machine-readable format.
  8. Upon withdrawal, the Seller may prevent the Client from further using the Digital Service.

§ 9 PROVISIONS CONCERNING ENTREPRENEURS (B2B)

  1. This section applies exclusively to entrepreneurs not covered by consumer protection.
  2. The Seller has the right to withdraw from an Agreement with a non-Consumer Client within 14 business days without stating reasons.
  3. The Service Provider may terminate the agreement with immediate effect and without stating reasons.

§ 10 PROVISIONS CONCERNING ENTREPRENEURS WITH CONSUMER RIGHTS

  1. A sole proprietor is covered by consumer protection provided the agreement does not have a professional character for them.
  2. Protection applies exclusively to: prohibited contractual provisions, liability for non-conformity, right to withdraw, and Digital Service agreement rules.
  3. Consumer protection is lost if the Agreement has a professional character, verified based on PKD codes.
  4. These entrepreneurs are not covered by institutional protection provided by consumer advocates or UOKiK.

§ 11 TYPE AND SCOPE OF ELECTRONIC SERVICES

  1. The Service Provider enables: registration and Account management, entering into Agreements for Digital Services, use of the Seeker Plan, and use of the Trial Period.
  2. Electronic Services are provided under the conditions specified in the Terms of Service.
  3. The Service Provider has the right to place advertising content on the Platform.

§ 12 CONDITIONS FOR THE PROVISION AND CONCLUSION OF ELECTRONIC SERVICE AGREEMENTS

  1. Account management, Seeker Plan, and Trial Period are provided free of charge. Premium Subscription and Credit Packs are paid in accordance with the price list in § 3, point 10.
  2. The Account agreement is concluded for an indefinite period. Premium Subscription renews automatically. Credit Pack agreement is fulfilled upon credit addition. Trial Period lasts 7 days.
  3. Technical requirements: a computer or mobile device with Internet access, access to email, a current web browser (Chrome, Firefox, Safari, Edge), cookies and JavaScript enabled.
  4. The User is obliged to use the Platform in a manner consistent with the law and good customs.
  5. The User is obliged to provide data consistent with the actual state of affairs.
  6. The User is prohibited from providing content of an unlawful nature.

§ 13 COMPLAINTS RELATED TO THE PROVISION OF ELECTRONIC SERVICES

  1. Complaints may be submitted via email at: contact@arcanaoftarot.com.
  2. The email should include as much information as possible regarding the complaint.
  3. The Service Provider shall process the complaint within 14 days.
  4. The response shall be sent to the User’s email address provided in the complaint.

§ 14 CONDITIONS FOR TERMINATION OF ELECTRONIC SERVICE AGREEMENTS

  1. The Account management agreement may be terminated. The User may terminate with immediate effect via email at contact@arcanaoftarot.com or through the Account deletion function.
  2. The Service Provider may terminate the agreement if the User violates the Terms of Service, after an unsuccessful prior request. The agreement expires after 7 days.
  3. Termination leads to the cessation of the legal relationship with effect for the future.
  4. The parties may terminate the agreement at any time by mutual agreement.

Account and Data Deletion

  1. The Client may request Account deletion through the Account deletion function or by contacting contact@arcanaoftarot.com.
  2. Upon Account deletion, the Service Provider shall: cancel the active Premium Subscription, permanently delete all Account data, and create an audit log entry (without personal data).
  3. Payment records may be retained by Stripe in accordance with its legal obligations.

Data Export

  1. The Client has the right to download an export of all their data in JSON format through the data export function in Account settings.

§ 15 INTELLECTUAL PROPERTY

  1. All content published on www.arcanaoftarot.com is protected by copyright and is the property of [COMPANY NAME].
  2. Any use without the express written consent of the Service Provider constitutes a copyright violation.
  3. All trade names, company names, and logos used on the Platform belong to their respective owners and are used solely for identification purposes.

§ 16 CONTENT MODERATION AND LIABILITY

  1. The Service Provider designates a DSA contact point at: contact@arcanaoftarot.com.
  2. It is prohibited to publish unlawful content, content unrelated to the Platform, content damaging the Provider’s reputation, obscene content, content promoting competitors, or content presenting generated interpretations as professional advice.
  3. The Service Provider may moderate such content (refusal, removal, blocking access, account suspension).
  4. Users retain the right to appeal moderation decisions via email at contact@arcanaoftarot.com. Appeals are processed within 14 days.
  5. Users may report prohibited content via email at contact@arcanaoftarot.com.
  6. Reports must contain: explanation of reasons, electronic location of the content, reporter’s details, and a good faith statement.
  7. The Service Provider shall confirm receipt and inform of resolution without undue delay.
  8. If the report is justified, the responsible User shall be informed of moderation with justification.
  9. If there is suspicion of a crime threatening life or safety, law enforcement shall be immediately informed.
  10. The Service Provider shall inform Users of significant Terms of Service changes.
  11. The Service Provider shall endeavor to inform Users in advance of possible disruptions.
  12. The Service Provider shall not be liable to Entrepreneurs for damages arising from use, inability to use, or malfunction of the Platform, system failures, force majeure, third-party actions, inability to log in, or consequences related to password loss.
  13. The User bears responsibility for providing an inaccessible email address.

§ 17 FINAL PROVISIONS

  1. Agreements entered into through the Platform shall be governed by Polish law.
  2. In the event of any inconsistency with applicable law, the relevant provisions of Polish law shall apply.
  3. The Seller is entitled to make changes to Digital Services delivered continuously in order to improve their functionality. Such changes shall not result in any costs to the Client.
  4. The Seller shall inform the Client of changes in a clear and comprehensible manner, including information about the date, characteristics, and the right to terminate the agreement within 30 days.
  5. The Seller is released from this obligation if it has provided the Client with the right to retain the Digital Service in an unchanged state at no additional cost.
  6. Disputes with Consumers shall be resolved first through negotiations, in accordance with the Act on Out-of-Court Resolution of Consumer Disputes.
  7. Consumer disputes — before the competent court under the Code of Civil Procedure; Entrepreneur disputes — before the court having jurisdiction over the Service Provider’s registered office.
  8. Consumers have the right to use out-of-court dispute resolution methods, including mediation and arbitration courts. A list of Permanent Consumer Arbitration Courts is available at: http://www.uokik.gov.pl/wazne_adresy.php#faq596.
  9. Consumers may use the Online Dispute Resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr.
